Acceptance of Terms

By downloading, installing, or using Tempy ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Relationship with Apple and Google

These Terms are a contract between you and Eodin Inc. (not Apple Inc. or Google LLC). Apple and Google are not responsible for the App or its content, and are not parties to these Terms. However:

• Apple is an explicit third-party beneficiary of these Terms with respect to your use of the App on iOS / iPadOS. Apple has the right (but is not obligated) to enforce these Terms against you.
• Google is an explicit third-party beneficiary of these Terms with respect to your use of the App on Android.
• Eodin Inc. — not Apple, Google, or any healthcare provider — is solely responsible for the App, its content, and any support or maintenance.
• Any product claims (warranty, fitness for purpose, statutory or otherwise) are Eodin's responsibility to address, except where they cannot be excluded under applicable law.

Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use this App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms.

By using this App, you represent and warrant that:

• You have the legal capacity to enter into these Terms
• If you are a parent or guardian, you accept these Terms on behalf of your minor child
• You will supervise any use of the App by minors under your care
• You are not in a country subject to a US government embargo, or designated by the US government as a "terrorist-supporting" country, and you are not listed on any US government list of prohibited or restricted parties (Apple App Store standard EULA requirement)

Medical Disclaimer

IMPORTANT: THIS APP IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.

Tempy is a health tracking tool designed to help parents monitor their children's fever and medication. The App is NOT a substitute for professional medical advice, diagnosis, or treatment.

Critical Guidelines

• Always consult your pediatrician or healthcare provider before giving any medication to your child
• Dosage information displayed in the App is based on publicly available FDA/AAP guidelines and is for reference purposes only
• The AI Coach is a rule-based message engine, NOT a personalized medical opinion or a clinical AI model. Its messages are templates triggered by your logged values, intended to surface general parenting reminders — not health advice.
• Outbreak alerts displayed in the App are informational summaries of the WHO's Disease Outbreak News (DON) feed. They are not real-time emergency notifications and do not replace your local public health authority's guidance, school notices, or your physician's advice. Always defer to local authorities for outbreak response.
• Never rely solely on this App for medical decisions
• Seek immediate medical attention for high fevers or concerning symptoms
• Do not delay seeking medical advice because of information from the App

Emergency Warning Signs

Seek immediate emergency medical care if your child shows:

• Fever above 104°F (40°C)
• Any fever in infants under 3 months old
• Difficulty breathing or rapid breathing
• Severe lethargy, unresponsiveness, or confusion
• Signs of dehydration (no tears, dry mouth, no wet diapers)
• Seizures or convulsions
• Rash that doesn't fade when pressed
• Persistent vomiting

No Medical Relationship

Use of this App does not create a doctor-patient or any other medical relationship between you and Eodin Inc. or any healthcare provider.

Assumption of Risk and Release of Liability

Your Acknowledgment

By using this App, you expressly acknowledge and agree that:

1. Information is for Reference Only: All information provided by the App, including but not limited to dosage references, temperature interpretations, AI Coach messages, and outbreak alerts, is for general informational and reference purposes only and does not constitute medical advice.

2. No Reliance: You should not rely on any information provided by this App as a substitute for professional medical advice, diagnosis, or treatment. Any reliance you place on such information is strictly at your own risk.

3. Your Responsibility: You are solely responsible for all decisions and actions you take based on information from this App, including any medication you administer to your child.

4. Professional Consultation Required: You must always consult with a qualified healthcare provider before making any health-related decisions or administering any medication to your child.

Release of Liability

To the fullest extent permitted by applicable law:

• Eodin Inc. is not responsible for any health outcomes, injuries, adverse reactions, or damages of any kind resulting from your use of this App or any actions you take based on information provided by this App.

• You assume all risks associated with using this App and acting on any information it provides.

• You release and hold harmless Eodin Inc., its officers, directors, employees, agents, and affiliates from any and all claims, demands, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from or related to:

  • Your use of the App
  • Any health decisions you make based on information from the App
  • Any medication administered based on dosage references shown in the App
  • Any delay in seeking professional medical care
  • Any adverse health outcomes
  • Any reliance on outbreak alerts in lieu of local public health guidance

Acknowledgment of Understanding

By continuing to use this App, you confirm that you have read, understood, and agree to this Assumption of Risk and Release of Liability. If you do not agree, you must immediately stop using the App.

THIS RELEASE OF LIABILITY IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY APPLICABLE LAW.

User Responsibilities

As a user of Tempy, you agree to:

• Provide accurate information about your children's health
• Consult with your pediatrician before acting on any dosage information
• Keep your account credentials secure
• Use the App only for its intended purpose
• Not share access with unauthorized individuals
• Report any suspected security breaches immediately

Permitted Use

The App is intended for:

• Personal, non-commercial use by parents and caregivers
• Tracking temperature and medication for children in your care
• Sharing health information with authorized family members

You may not:

• Use the App for commercial purposes
• Attempt to reverse engineer or modify the App
• Use the App to collect data from other users
• Violate any applicable laws or regulations
• Use the App as a substitute for professional medical advice
• Use the App in the development, design, manufacture, or production of nuclear, missile, chemical, or biological weapons (Apple App Store standard EULA requirement)

Family Sharing

When using the family sharing feature:

• You are responsible for who you share access with
• Shared members can view and add health logs for shared children
• The account owner maintains control over access permissions
• Up to 5 members (account owner + 4 invited) can join a single family group on Tempy Pro
• We are not responsible for actions taken by shared members
• You must ensure all shared members understand these Terms

Subscription & Payments

Tempy is available as a free tier and as a paid subscription ("Tempy Pro").

Free vs Pro

Pricing and Auto-Renewal

Tempy Pro is offered as an auto-renewing subscription. Specific pricing is shown in the in-app paywall before purchase (currently $2.99/month in the US, with a discounted annual plan available; local-currency equivalent applies elsewhere). By purchasing, you agree to the following:

• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew at the same price for the same billing period unless cancelled at least 24 hours before the end of the current period. The renewal charge is processed by Apple / Google during the 24-hour period before the end of the current period.
• Managing or cancelling: You can manage or cancel your subscription at any time through your Apple ID account settings (iOS) or Google Play subscriptions (Android). Cancellation takes effect at the end of the current paid period; you retain Pro access until then.
• Free trial / promotional periods: If a free trial is offered (e.g., the 24-hour PDF report preview), the trial converts to a paid subscription automatically at the end of the trial unless you cancel before it expires. You can cancel during the trial without charge.
• Refunds: Refunds are handled exclusively by Apple App Store or Google Play according to their policies. Eodin Inc. cannot issue refunds directly for subscriptions purchased through the app stores.
• Price changes: Any price increase will be communicated to you in advance with the opportunity to cancel before the new price takes effect.

EU / EEA / UK Right of Withdrawal

If you are a consumer in the EU, EEA, or UK, you normally have a 14-day right of withdrawal for digital content purchased online (Directive 2011/83/EU as implemented locally).

By purchasing Tempy Pro, you expressly request that the digital service begin immediately upon purchase and you acknowledge that you thereby lose your right of withdrawal once you start using the Pro features. If you have not yet used any Pro feature, you may still cancel within 14 days for a full refund by contacting official@eodin.app.

This does not affect statutory consumer-protection rights that cannot be waived under your local law.

Intellectual Property

All content, features, and functionality of the App are owned by Eodin Inc. ("Company") and are protected by international intellectual property laws. You may not:

• Copy, modify, or distribute App content
• Use the Tempy name or logo without written permission
• Create derivative works based on the App
• Remove any copyright or proprietary notices

You retain ownership of all health data you enter into the App. By using the App, you grant us a limited, royalty-free license to process this data solely for providing the App's services.

License Grant

Eodin Inc. grants you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple- or Google-branded devices that you own or control, solely as permitted by Apple's App Store Terms of Service or Google Play Terms of Service.

Third-Party Services

The App relies on the following third-party services. Your use of the App is also subject to the terms and privacy policies of these providers, and we are not responsible for their independent practices:

• Firebase / Google LLC — Authentication, push notifications, analytics, crash reporting
• Supabase Inc. — Database, real-time sync, file storage
• RevenueCat, Inc. — Subscription state and receipt validation
• Google AdMob — In-app advertising on the free tier
• World Health Organization (WHO) — Read-only outbreak data feed (Disease Outbreak News)
• Apple App Store / Google Play — Distribution and billing
• Eodin Analytics SDK — In-house product analytics

Limitation of Liability

To the maximum extent permitted by applicable law:

• The App is provided "as is" and "as available" without warranties of any kind
• We do not warrant that the App will be uninterrupted, error-free, or secure
• We are not liable for any health outcomes related to App use
• We are not responsible for data loss or service interruptions
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100 USD, whichever is greater

Nothing in these Terms excludes or limits our liability for:

• Death or personal injury caused by our negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot be excluded or limited by applicable law

For EU / UK Users: Nothing in these Terms affects your statutory rights as a consumer under applicable EU / UK law.

Indemnification

You agree to indemnify and hold harmless Eodin Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights

Termination

Termination by You

You may delete your account at any time through the App settings. Upon deletion, all your personal data will be permanently removed within 30 days.

Termination by Us

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe:

• Violates these Terms of Service
• Is harmful to other users or the App
• Is fraudulent or illegal
• Is required by law

Upon termination, your right to use the App ceases immediately. Unused subscription periods may be refunded at Eodin's discretion or per the applicable app store's refund policy.

Changes to Terms

We may update these Terms of Service from time to time. We will notify you of material changes at least 30 days before they take effect through the App or email. Your continued use of the App after the effective date constitutes acceptance of the updated Terms.

If you do not agree to the updated Terms, you must stop using the App and delete your account.

Governing Law and Dispute Resolution

General

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions — subject to mandatory consumer-protection laws of your country of habitual residence, which apply regardless of this clause.

Regional Provisions

For users in the United States:

• Any dispute shall be resolved in the state or federal courts located in Delaware
• California residents: You have specific rights under CCPA/CPRA as described in our Privacy Policy

For users in the European Union / EEA / United Kingdom:

• These Terms do not affect your statutory consumer rights under applicable EU/EEA/UK law
• You may bring legal proceedings in the courts of your country of residence
• Nothing in these Terms limits your rights under GDPR or UK GDPR
• For GDPR-related matters, EU law applies to the extent required

For users in the Republic of Korea:

• These Terms do not affect your statutory consumer rights under Korean consumer-protection law (소비자기본법, 약관규제법)
• For privacy-related matters, Korean PIPA (개인정보 보호법) applies and you may lodge a complaint with the Personal Information Protection Commission (개인정보보호위원회)
• Courts of competent jurisdiction in Seoul may be brought as an alternative forum at your election

For users in other jurisdictions:

• These Terms are governed by Delaware law, except where local consumer protection laws require otherwise
• If any provision is found unenforceable under local law, only that provision shall be modified to the minimum extent necessary

Informal Resolution

Before filing any legal claim, you agree to try to resolve any dispute informally by contacting us at official@eodin.app. We will try to resolve the dispute within 30 days.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eodin Inc. regarding the use of the App.
